3. Purpose of the general conditions of sale and use
The purpose of these general conditions of sale and use (hereinafter referred to as the "General Conditions") is to define the rights and obligations of the Members within the framework of the use of the Services, the subscription, if applicable, to a Subscription, and possibly the payment of the Babysitters employed via the platform.
In addition, it is specified that the BBS company is an intermediary, limited to putting Members in touch with each other within the framework of the childcare organisation.
BBS does not intervene in any way in the contractual relationship that may arise between the Members.
Consequently, the BBS cannot be assimilated to the employer of the babysitters and does not remunerate, in any form whatsoever, its Members.
4. Scope of the General Terms and Conditions
These General Terms and Conditions do not govern the conclusion or execution of the employment contract, concluded directly between the Parents and the Babysitters, but exclusively govern the use of the Services by the Members and in particular the subscription to the Subscriptions.
These Terms and Conditions are the only contractual documents that govern the contractual relationship between the company BBS and its Members, to the exclusion of any other document.
5. Availability of General Terms and Conditions
The General Terms and Conditions are available at any time on the website of the company BBS where they are directly viewable, downloadable and printable.
The Member acknowledges that, by completing his registration, he has been made aware of the General Terms and Conditions, has understood them and has accepted them unreservedly, irrevocably and definitively before making full use of the Services and, where applicable, taking out a Subscription.
Membership of a Subscription is equivalent to full and complete adherence to the General Terms and Conditions in force on the day of membership.
6. Modification of the General Terms and Conditions
The company BBS reserves the right to modify its Terms and Conditions at any time.
In the event of changes, the General Terms and Conditions in force at the time of Subscription will continue to apply.
These General Terms and Conditions come into force on the date indicated at the top of these Terms and Conditions and will apply to any Subscription contract entered into on or after this date.
7. How to access the Services on the Baby Sittor application

Registration may be made by any natural person, enjoying full legal capacity to enter into a commitment hereunder, having identity papers that comply with French regulations and, for Babysitters, being over 16 years of age.

The Member certifies that all the data it communicates are true, accurate, complete and correct. Trust being the order of the day, any personal information that is fanciful, false or incomplete is likely to result in the closure of the account. BBS reserves the right to ask the Member to communicate at any time elements to prove his identity and the information transmitted on the BABY SITTOR Application. The Member certifies in particular that it has identity papers and is legally present on French territory. The Member may at any time access the "My Account" section to modify the information concerning him/her.

Each Member may have only one account, which is personal to him/her and which may not be assigned or transferred in any way whatsoever.
8. Why referrers?
The Services offered by BBS require that Members can feel confident. Therefore, each new Member is given the opportunity to be sponsored by existing Members of the community. BBS reminds Referrers who agree to sponsor another Member, new or existing, that they must know this person personally and that they are morally responsible for it. Also, the Referrer is informed and accepts that any fraudulent sponsorship and / or any behavior of the sponsored Member contrary to the Terms and Conditions may result in the closure of the account of the Referrer and the Member concerned.
Each Member accepts that BBS notifies him/her of sponsorship requests from persons wishing to become a Member as long as he/she is among the Facebook contacts of these persons. Requests for sponsorship are sent by SMS, email or Facebook.
9. Methods of payment
The Services are invoiced to the Parents directly by the BBS company. In order to collect payments, BBS uses the services of the company Stripe, specializing in secure payments. By using the payment system Stripe proposed by BBS, Members accept the Terms and Conditions of Stripe Payments Europe, Ltd available here: www.stripe.com/legal
Payment is made exclusively by credit card or Apple Pay.
The undertaking to pay given by means of a payment card is irrevocable. By providing their banking information at the time of membership, the Parents authorize the company BBS to immediately debit their credit card for the amount relating to the price indicated. To this end, the Parents confirm that they are holders of the credit card to be debited and/or that they are legally entitled to use it.
The information transmitted is encrypted in a state-of-the-art way and cannot be read during transport over the network via https security. Once the payment is initiated by the Customer, the transaction is immediately debited after verification of the information.

The Subscriptions offered by the company BBS constitute digital content not provided on a physical medium as defined by Article l.221-1 of the Consumer Code.
Parents are informed that in accordance with Article L.221-28, 13° of the French Consumer Code, the right of withdrawal cannot be applied to Subscriptions subscribed to insofar as they constitute the supply of digital content not supplied on a physical medium, the performance of which begins after the consumer's prior express agreement and express renunciation of his or her right of withdrawal.
The Parents therefore acknowledge that they have been informed and expressly and unreservedly waive their right of withdrawal.
By accepting the Terms and Conditions and by joining one of the Subscription forms offered by the company BBS, it is considered that the Parents have expressly waived their right of withdrawal.
11. What are the services?
To date, the BABY SITTOR Application is a networking tool allowing Members to organize childcare. BBS does not intervene in any way on the Announcements and on the Babysitters' applications.
The quality of the Services depends on the seriousness and quality of the Members. This is why BBS invites Members to sponsor other Members and to rate other Members after each babysitting.
If BBS does not yet offer online services facilitating exchanges between Members, such as messaging services, BBS offers a solution for online payment of Babysitters by Parents, as described in Article 10.
However, BBS wishes to reserve the right to evolve its Services in order to best meet the needs of its Members. This is why BBS is likely to modify the list of its Services at any time and to modify the pricing conditions of certain Services. If the Member does not accept the Terms and Conditions thus amended, he may terminate his account and stop using the Services of BBS.

Members are informed and accept that their telephone numbers may be made available to other Members for the exclusive purpose of babysitting missions and in accordance with article 21 below.
14. How to notify BBS of an inappropriate content or behavior?
BBS expects from its Members and each Member expects from other Members an exemplary, responsible and ethical behaviour, respectful of the laws and regulations in force, in order to guarantee quality Services.
BBS invites Members to notify it of any Content that is manifestly illegal, contrary to the terms of these Terms and Conditions or legal and regulatory conditions, without delay, by email to hello@babysittor.com. The Member shall indicate in particular his surname, first names, profession, domicile, nationality, date and place of birth and a precise description of the facts in dispute. BBS will make its best efforts to suspend or remove the manifestly illegal Content or close the account of the offending Member.
Accordingly, Members are informed and accept that the Content they distribute, their behavior and their words via the BBS Services are likely to be reported by other Members and controlled by BBS. If BBS considers that the report is founded, the Member agrees that BBS withdraws Content published by the Member or suspend or terminate the Member's access to his account.
15. How much babysitters have to be paid?
Before any mission assigned to a Babysitter, the Parent and the Babysitter must agree on the financial terms. BBS does not interfere in any way in defining the price of services provided by the Babysitter. Babysitters are not employees, servants, contractors or agents of BBS.
It is reminded that on 1st January 2024, the hourly minimum wage is as follows:
| Gross | Net | |
|---|---|---|
| Hourly minimum wage excluding paid vacation | 11,88 euros | 9,40 euros |
| Hourly minimum wage 10% paid vacation included (CESU) | 13,09 euros | 10,34 euros |
Contributions are calculated on the basis of the gross hourly minimum wage.
Unless expressly exempted by law, no remuneration may be less than the minimum wage.
16. Parents' Reporting Obligations for Employee Babysitters
The Members who use the Services offered on the BABY SITTOR Application undertake to respect the legal and fiscal obligations relating to the employment of people at home. BBS excludes any responsibility concerning the respect by the Members of their legal and fiscal obligations.
Parents are informed that by using the services of a Babysitter, they are acting as individual employers. As such, they must declare the Babysitter and the amounts paid to him/her using, for example, the Cheques for Universal Employment Services (CESU).
For more information, Members can consult, in particular, the following websites www.cesu.urssaf.fr, www.pajemploi.urssaf.fr, www.service-public.fr.
Babysitters must also declare for income tax purposes the income received as a result of their use of the BABY SITTOR Application Services.
Declaring Babysitters is mandatory and important. It allows you to be covered by insurance. It also makes it possible to benefit from tax advantages, up to 50% of the amount of expenses actually incurred (salaries and social contributions) up to a ceiling of 12,000 euros, which may be increased in certain cases. For any further information, Members may contact their Public Finance Centre or consult the following website www.impots.gouv.fr.
17. Babysitter payment terms
Parents may decide to pay the Babysitters by any means. BBS will not be held responsible in case of default of payment of a Babysitter by a Parent.
BBS offers a secure online payment solution. Payment is made by credit card based on information provided to BBS by Members (price and time of the mission).
When paying by credit card, the Member is redirected to Stripe's secure payment servers. In order to proceed with the payment, each Member will be asked to communicate the number and expiration date of his or her credit card as well as the cryptogram. The recording of the transaction is subject to a request for authorization. The Member guarantees that he or she is authorised to use the payment card provided for the payment of his or her order.
In the event that the Member expressly consents, the Member's credit card data will be kept encrypted by Stripe to facilitate future transactions.
In return for this Payment Service, the Parent agrees to pay a commission. The amount of this commission will be communicated to the Parent before the validation of the remuneration paid to the Babysitter by means of this online payment solution.
18. Member Ratings
Parents and Babysitters expressly agree that their behaviour and performance will be rated and made available to other Members. BBS draws the attention of Members to the fact that it is not in any way to rate the person. The purpose of these ratings is to ensure the quality of babysittings and to preserve the trust of Members.
The rating consists of assigning a score (from 1 to 5).
Babysitters and Parents must give each other a grade at the end of a babysitting session.
Members also have the possibility to leave comments which must be objective and in conformity with the General Terms and Conditions. Members expressly accept that these comments are published on the BABY SITTOR Application and that they appear as the authors.
The BABY SITTOR Application disseminates all these grades given by Members as well as any comments that may be attached to them.
BBS reserves the right to terminate the account of the Member who has received one or more scores equal to or less than 4.
